JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.

It is alleged that the petitioner was authorized by SBPDCL for collection of energy charges of Kharenda and Pasai Panchayat. The petitioner collected `3,38,504/- from June, 2014 to January 2015 but he did not deposited the collected amount. It is submitted by learned counsel for the petitioner that the petitioner was busy with the treatment of his son who is suffering from kidney failure, hence he could not deposit the money and now the petitioner deposited Rs. 1,20,000/-. The petitioner undertakes to deposit balance amount within a period of nine months.

No.23647 of 2015 (2) dt.07-07-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for nine months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur, Bhabhua in connection with Bhabhua P.S. Case No. 18 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court below on deposit of balance due amount within a period of nine months.
