The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

Prosecution case in brief is that on the alleged date and time of occurrence when the informant and his family members were sleeping, the daughters of informant raised alarm. Then informant woke up and saw that eight persons having covered their faces were searching goods. When informant protested the accused persons started fleeing and in that process the accused persons took cash of Rs. 70,000/- from the box and ornaments. The accused persons fired which hit on the thigh of informant.

Name of petitioner transpired in this case on the basis of confessional statement of co-accused Chandrika Yadav. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIIIth, Siwan in connection with Raghunathpur P.S. Case No. 4 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
