2. The instant application has been filed on behalf of the petitioner for grant of provisional bail on the ground that a male child has been born to the wife of the petitioner on 12.07.2023 who has been diagnosed with jaundice and the presence of the petitioner is required for his treatment.
3. Learned counsel for the petitioner submits that the petitioner is in custody since long time and there is no male member in his family to look after the new born child of the petitioner. The wife of the petitioner is facing much hardship. Learned counsel further submits that the petitioner may be released on provisional bail at least for 15 days.
4. Having considered the submission made on behalf
Patna High Court CR. MISC. No.52915 of 2023(2) dt.16-08-2023 2/2 of the petitioner, the petitioner above named is directed to be released on bail provisionally till 06.09.2023 on furnishing bail bonds of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IX, Samastipur/concerned court in connection with Sessions Trial No. 182 of 2022, arising out of Musarigharari P.S. Case No. 99 of 2021, subject to the conditions mentioned in Section 437(3) of the Code of Criminal Procedure.
5. The petitioner must surrender before the learned court below on or before 07.09.2023, failing which the learned court below will be at liberty to take coercive action against the petitioner.
