JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1264 of 2018, corresponding to Trial No.216 of 2018, instituted for the offences punishable under Sections 467 and 471 of the Indian Penal Code.

As per complaint petition there is allegation that in a proceedings under Section 144 and 145 of Cr.P.C. petitioner produced forged and fabricated sale deed with respect to land bearing R.S. Khatiyan No. 335, Chak Plot No. 882/13, area 6 & 1⁄2 decimals and on that cognizance has been taken by learned Magistrate.

Submission of learned counsel for the petitioner is that even according to complaint petition sale deed was

Patna High Court CR. MISC. No.50207 of 2019(6) dt.15-11-2019 2/2 executed in the year 1990 and after a long time allegation has been made and petitioner is ready to face the trial and since cognizance has been taken there is no chance of tampering with the evidence.

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Hemant Kumar, Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Trial No. 216 of 2018, arising out of Complaint Case No. 1264 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that petitioner has to co-operate in the trial and appear in trial court as and when required.
