2. The petitioners seeks regular bail in connection with Dalsingsarai P.S. Case No. 320 of 2023, registered for the offence under Sections 457 and 380 of the Indian Penal Code.

3. As per the prosecution case, the petitioners are accused in of committing theft. They are husband and wife and are accused in 17 cases of similar nature.

4. Learned counsel for the petitioners submits that petitioners are innocent and have not committed any offence. Petitioners are in custody since 06.11.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed so far as petitioner no. 2 namely Rinku Kumari @ Rinku Devi is concerned.

7. So far as petitioner no. 01 (Uttam Kumar Sahni @ Uttam Sahni) is concerned, this application is dismissed with respect to him.

8. Let the petitioner no. 2 above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Dalsingsarai, DistrictSamastipur in connection with Dalsingsarai P.S. Case No. 320 2023, subject to the condition that the petitioner no. 2 will mark her attendance at Bachhwara Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner no. 2.

9. This application stands partly allowed.
