JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 24.5.2016 for the offences punishable under Sections 386, 387, 504, 435, 427, 323, 341, 147, 148, 149 of the Indian Penal Code and Section 17 of Criminal Law Amendment Act.
Petitioner is not named in the First Information Report. It is stated that ten unknown extremists burnt J.C.B. machine and demanded extortion money.
In course of investigation, the name of petitioner came in this case in the information furnished by spy of police and subsequently, Special Intelligence group also sent information regarding the involvement of the petitioner in the present case.
Patna High Court Cr.Misc. No.29833 of 2016 (2) dt.28-07-2016 2/2 However, it appears from the impugned order that the petitioner was arrested and made his confessional statement. Even if the aforesaid materials are taken into consideration, then also it is obvious that except confessional statement of petitioner as well as some criminal antecedents, there is nothing against him.
Accordingly, the petitioner above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Aurangabad, in connection with Pauthu P.S.
