2. This is the second attempt of the bail of the petitioner. Earlier the prayer of regular bail of the petitioner was rejected vide order dated 18.10.2023 passed in Cr. Misc. No. 67896 of 2023.

3. The petitioner seeks regular bail in connection with Fulkaha P.S. Case No. 16 of 2023, registered for the offence punishable under Sections 413, 414 of the Indian Penal Code.

4. As per prosecution, the petitioner is alleged to have stolen a four wheeler vehicle (Scorpio) which was recovered from the possession of the petitioner. The petitioner is accused in 8 more criminal cases. The petitioner is in jail since 12.02.2023.

5. Learned counsel for the petitioner submit that petitioner has falsely been implicated in this case.

6. Learned APP has vehemently opposed the prayer for bail.

7. Considering the period of custody and accusation of theft, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, Araria in connection with Fulkaha P.S. Case No. 16 of 2023, subject to condition that:

(i) The petitioner will mark his attendance at Fulkaha Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. He will cooperate in the trial either by personally in the trial court on each and every date fixed for hearing.

(ii) The bailor should be close relative of the petitioner.
