JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-08-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 19.05.2016 passed in Cr. Misc. No. 15150 of 2016, on the ground that the petitioner is in custody since 21.08.2015 and liberty was given to renew the prayer after examination of the victim and the informant during trial. The victim and the informant have already been examined and they have not supported the allegation of kidnapping vide annexure-2.

Learned APP does not oppose the prayer of bail.

In the facts and circumstances stated above, the

Patna High Court Cr.Misc. No.31441 of 2016 (3) dt.10-08-2016 2/2 petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned Additional Sessions Judge V, Nawada in S. Tr. No. 457/15/528/16 arising out of Nardiganj P.S. Case No. 94 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
