JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Matihani P.S. Case No. 71 of 2018 instituted for the offence under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that 36 bottles of foreign liquor has been recovered from beneath the straw house of the petitioner.

Counsel for the petitioner submits that co-accused Bikram Kumar with similar allegation has already been granted bail by a coordinate Bench of this Court vide order dated 21.08.2018 passed in Cr. Misc. 51452 of 2018. Petitioner is said to be in custody since 24.07.2018. Seizure list has been enclosed which does not bear

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Anil Kumar Sinhal, learned Additional Sessions Judge-II, Begusarai, cum Special Judege, Bihar Prohibition & Excise Act, 2016 in connection with Matihani P.S. Case No. 71 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
