JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 420, 406, 506/34 of the Indian Penal Code.
As per the prosecution the main accusation against the petitioners is of committing cheating in respect of 15 katha land by taking rupees fifteen lacs and executing a registered sale deed but did not give possession to the informant.
It has been submitted on behalf of the petitioners that the dispute is civil in nature. Further it has been submitted that the petitioners have falsely been implicated in the present case. It is
Patna High Court Cr.Misc. No.22191 of 2015 (2) dt.13-07-2015 2/2 further submitted that the petitioners are ready to deposit an amount of Rs. 25,000/- in court below which shall be subject to final disposal of the case.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, the above named petitioners are directed to deposit an amount of Rs. 25,000/- in court below, which shall be subject to final disposal of the case and on doing so, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M.,Siwan, in connection with Barharia P.S.Case No. 6 of 2015 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
