ANSHUMAN ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner and the State. The present case has been filed for proper investigation of Beur P.S. Case No. 286 of 2019, dated 13.08.2019, registered under Section 363 of the Indian Penal Code.

Counsel for the State submits that the petitioner is not named in the first information report.

In this view of the matter, I am not inclined to quash the first information report, but, liberty is granted to the petitioner that he shall represent to the Senior Superintendent of Police, Patna (respondent no. 3) in the light of the order passed by the coordinate Bench in Cr.W.J.C. No. 153 of 2017 (Surendra Singh Vrs. State of Bihar & Ors.) and analogous cases decided

Patna High Court CR. WJC No.80 of 2021(3) dt.18-04-2023 2/2 on 09.09.2022 within four weeks from today and the Senior Superintendent of Police shall consider the representation and take appropriate action.

With this observation, this criminal writ petition is disposed off.
