2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise (Amendment ) Act 2022 . 3 . Prosecution case is that 30 liters of illicit liquor was recovered from road side .

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . The name of petitioner was disclosed by local people . Recovery is from open place . No incriminating material has been recovered from the conscious possession of the petitioner.

5 . Learned counsel for the state opposed the bail.

No.53927 of 2025(2) dt.12-08-2025 2/2 circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned special Judge Exclusive Excise Court - 02 Sitamarhi in connection with Sitamarhi Police Station Case No. 393 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
