Petitioner seeks bail in a case registered under sections 272, 273, 290 of the Indian Penal Code and 47A of the Excise Act. Indian made foreign liquor is said to have been recovered from the house of the petitioner but according to the prosecution case itself, the aforesaid recovery was made prior to coming into force of Bihar Excise Amendment Act, 2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Begusarai in Khodabandpur P.S.
