The petitioner is languishing in custody since 10.06.2016 in a case registered for the offences punishable under sections 498A and 494 of the Indian Penal Code. Basic accusation is of torture, performing second marriage and disputing the factum of marriage by the petitioner. The petitioner was granted provisional anticipatory bail for six months vide Criminal Miscellaneous No.42938 of 2014, which was to be confirmed after the enquiry being conducted by the learned Court below with regard to the factum of marriage, if it is found that the petitioner has never performed marriage with the complainant but the petitioner was to surrender

Patna High Court Cr.Misc. No.33571 of 2016 (2) dt.10-08-2016 2/2 if it is found that the petitioner has performed marriage with the complainant. During enquiry, the factum of marriage was found true and, consequently, the petitioner surrendered before the learned Court below.

Considering the nature of accusation, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Purnea, in connection with Complaint Case No.2045/2013.
