The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 302, 120(B), 379/34 of the Indian Penal Code.
Allegation against the petitioner and other coaccused persons is that they assaulted the brother of the informant by bricks due to which he succumbed to injuries.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has

It is further submitted that, from the perusal of the case diary, it appears that the incidence took place on 28.03.2022 at 11:30 P.M. and the postmortem of the victim was conducted on 29.03.2022 at 2:00 P.M. but the F.I.R has been registered on 30.03.2022 at 11:30 A.M. which suggests that a false and concocted story has been planted against the accused persons including the petitioner. There is an inordinate delay of one day in lodging the F.I.R. It is further submitted that there is no cogent material evidence against the petitioner in the alleged offence. Moreover, the petitioner is languishing in judicial custody since 31.03.2022.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named
