JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-379, 384 & other minor sections of the Indian Penal Code.

The accusation against the petitioner is that he along with other FIR named accused as well as unknown persons, committed loot of crops of the informant but submission on behalf of petitioner is that there is land dispute between the parties and as a matter of fact, prior to institution of the present case, the informant as well as his henchmen lodged several cases against the petitioner and the details of the aforesaid cases have been given at paragraph-3 of the petition.

No.30977 of 2016 (2) dt.11-08-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioner is in jail custody since 25-03-2016, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bihra P.S. Case No. 231 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Saharsa.
