The petitioner seeks bail in a case registered for the offence under Section 302/304(B)/201/34 of the Indian Penal Code.

As per the prosecution case, this petitioner killed the daughter of the informant due to non-fulfillment of demand of dowry. Petitioner happens to be husband of the deceased. It is submitted that petitioner has been falsely implicated in this case only on suspicion. Post-mortem report does not support the prosecution case and dead-body of the deceased was disposed in presence of informant. Petitioner is in custody since 29.03.2021.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is husband of deceased

Patna High Court CR. MISC. No.62261 of 2021(3) dt.04-04-2022 2/2 and deceased has died in an unnatural circumstances within seven years of marriage and in post-mortem report also, the doctor has opined that death was caused due to complete throat cut.

Considering the nature & gravity of offence and the fact that petitioner is husband of the deceased, the bail petition of petitioner is rejected.
