JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-12-2022 Heard learned counsel for the petitioner and Mr. Iqbal Asif Niazi, learned AC to GP-5 for the State. In this case, the petitioner is praying for a direction to the Respondent Nos. 3 and 5 to conclude the investigation and arrest the accused persons in Turkauliya P.S. Case No. 456 of 2022 registered for the offences under Sections 341, 323, 302, 120B of the Indian Penal Code.
A counter affidavit has been filed in this case. In paragraph '9' of the counter affidavit, it is stated that in the supervision report of the Sub-Divisional Police Officer, Sadar, five witnesses were examined and they have told that the
Patna High Court CR. WJC No.1149 of 2022(3) dt.12-12-2022 2/2 deceased died because of electric shock for which initially letter was submitted by the wife of the deceased against which U.D. Case No. 7 of 2021 was registered but due to previous enmity, Complaint Case vide C-1825 of 2021 was registered by the complainant maliciously and falsely.
In the given facts and circumstances and in the kind of stand which has been disclosed in the counter affidavit, this Court is of the considered opinion that the investigation of the case has already concluded and in case, the petitioner is aggrieved by the conclusion reached by the investigating agency, upon submission of a police report, he may take appropriate steps in accordance with law in the learned court below for redressal of his grievance.
