JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 328, 201 and 34 of the Indian Penal Code. Allegation against petitioner is that he is said to have given poison in the food of daughter and grand-daughter of the informant, due to which daughter died and grand-daughter is under treatment.

It has been submitted on behalf of the petitioner that he is in custody since 21.3.2016. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is said to have falsely implicated in the present case. A number of witnesses in the case diary have stated that deceased had committed suicide. Chargesheet has also been submitted under Section 306 of the Indian Penal Code. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
