The petitioners are in custody since 26.07.2018 in connection with G.R. Case No. 787 of 2018 arising out of Jainagar P.S. Case No. 291 of 2018 for the offence registered under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioners submits that the alleged recoveries were not from the conscious possession of the petitioners and they were also not named in the first information report but they were subsequently, arrested only because of their criminal antecedent which relates to similar case under the Excise

Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Madhubani in connection with G.R. Case No. 787 of 2018 arising out of Jainagar P.S. Case No. 291 of 2018. (Anjana Mishra, J) Jagdish/- U T
