In this case, the petitioner is seeking bail in connection with Mahishi P.S. Case No. 71 of 2010 registered for offences under sections 147, 148, 149, 341, 323, 427, 384, 307, 506 of the Indian Penal Code and Section 16 & 17 of the C.L.A. Act.
As per allegation, the petitioner has demanded extortion money from the Informant.
This case is of the year 2010, the petitioner remained absconding thereafter for six long years. From paragraph no.3, it is clear that the petitioner carries number of criminal cases including a case lodged in the year 2012. The plea of the petitioner that he
Patna High Court Cr.Misc. No.32420 of 2016 (2) dt.18-08-2016 was outside the native place is completely belied. The petitioner has placed reliance on an order of this Court dated 10.11.2010 in Cr. Misc. No. 38533 of 2010 which was passed just after the commission of the offence but, in this case, the petitioner remained absconding for long six years. In that view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, namely, Uday Sada @ Manoj Sada @ Major is rejected. The petitioner is given liberty to renew his prayer for bail after nine months of his judicial custody. (Shivaji Pandey, J) Rishi/- U T
