JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 366(A)/34 of the Indian Penal Code.
No doubt, the petitioner is named in the First Information Report but the informant claimed in his written report that it was co-accused Pawan Kumar Das, who kidnapped his daughter. The petitioner happens to be the brother of co-accused Pawan Kumar Das and there is only allegation against him that he as well as other co-accused are also involved in committing the occurrence. Co-accused Balmiki Das and Golu Choudhary, having more or less similar allegation, have already
Patna High Court Cr.Misc. No.36111 of 2016 (3) dt.31-08-2016 2/2 been granted privilege of bail, whereas the petitioner is in jail custody since 03.07.2016.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P.S. Case No. 29 of 2016.
