JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 23-01-2015 Despite repeated calls, none appears to press the application. Learned counsel for the State is present. The prayers of the petitioner in paragraph 1 of the writ petition are as under :- "1. That the petitioner seek indulgences of this Hon'ble Court for the following reliefs :- (i) An appropriate writ(s), order(s), direction(s) quashing the order dated 27-09-2013 (Annexure-8) passed by the Sub-Divisional Magistrate, Lakhisarai (Respondent No.3), in Case No.665(M) of 2013 whereunder the SubDivisional Magistrate, Lakhisarai, ordered to seal the hotel of the petitioner namely M/s Hotel Shanti INN for one year.
(ii) An appropriate writ(s), order(s), direction(s), commanding the Respondents to act in accordance with law.
(iii) Any other order(s) to which this Hon'ble Court may deem fit and proper for giving complete justice to the petitioner."
Patna High Court Cr. WJC No.269 of 2014 (2) dt.23-01-2015 2/2 By the impugned order dated 27th September, 2013, as contained in Annexure-8 to the writ petition, in exercise of powers conferred under section 18 of the Immoral Traffic (Prevention) Act, 1956, the Sub-Divisional Magistrate, Lakhisarai directed that the hotel of the petitioner running in the name and style of M/s Hotel Shanti INN shall be sealed for one year. During the pendency of the writ application, the period for which the aforesaid hotel was ordered to be sealed has already lapsed.
In that view of the matter, the application for quashing of the order dated 27th September, 2013 has become infructuous. Accordingly, the writ petition is disposed of as infructuous.
