The petitioner wants to renew his prayer of bail, which was earlier dismissed as not pressed vide order dated 14.10.2015 passed in Cr. Misc. No. 27185 of 2015, on the ground that the petitioner is in custody since 19.03.2015, charge has been framed on 14.07.2016, but up till now no prosecution witness has been examined. The learned trial judge has stated that he will try at best to dispose of this case within six months, but the trial is not likely to be concluded in near future.
Learned A.P.P. submits that the petitioner is named by the informant and other witnesses.
In the facts and circumstances stated above, at
Patna High Court Cr.Misc. No.30362 of 2016 (3) dt.24-08-2016 2/2 present, I am not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected in connection with Kharagpur P.S. Case No. 83 of 2014 (G.R. Case No. 697 of 2014) pending in the court of learned Sessions Judge, Munger. However, the learned trial court is directed to expedite the trial and to conclude the same preferably within six months, as sought by him, failing which the petitioner may be at liberty to renew his prayer for bail.
