JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

The accusation is of committing theft in the house of the petitioner. The FIR was lodged against unknown. During investigation, some of the witnesses suggested the name of the petitioner.

It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.22750 of 2015 (2) dt.25-06-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Shankarpur P.S. Case No. 42 of 2014 pending in the court of learned CJM, Madhepura. Accordingly, the application is disposed of.
