The petitioner is accused in connection with Pirbahore P.S. Case No. 80 of 2015, registered under Sections 461 and 379 of the Indian Penal Code and Section 66©(d) of the I.T. Act.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has been surfaced in the confessional statements of Ritesh @ Amit @ Ramit @ Vikash Chaturbedi, Ratan Kumar, Sambhu @ Karan Singh and Md. Soyeb Seikh having hand in the present case, except the confessional statement, there is nothing against the petitioner. Further submission is that similarly situated co-accused Ritesh @ Ramit @ Amit @ Vikash Chaturvedi, Sunil Singh @ Sem, Shambhu @

Patna High Court Cr.Misc. No.29093 of 2016 (2) dt.20-07-2016 2/2 Karan Singh @ Shambhu Jha have already been allowed on bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No. 13282 of 2016, dated 07.04.2016, Criminal Miscellaneous No.14486 of 2016, dated 13.05.2016 and Criminal Miscellaneous No. 18068 of 2016, dated 13.05.2016, respectively. The petitioner is in custody since 29.09.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Pirbahore P.S. Case No. 80 of 2015.

Out of two sureties, one surety must be the close relative of the petitioner and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and further the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds (Rajendra Kumar Mishra, J.)
