JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioners are apprehending their arrest in connection with Industrial Area, Buxar PS case No. 40/2015 for the offence under section 307.34 and some other sections of the Indian Penal Code and section 27 of the Arms Act.. Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that on 26.03.2015 the informant and his nephew were present in the field, in the meantime, the petitioners and other accused persons fired two rounds from their Katta which did not hit the informant. Further the accused persons having iron rod and axe have assaulted the informant and his nephew and on sound of hulla, the nearby people started assembling, the accused persons including the

It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Further, it is submitted that no injury has been caused to the informant in course of the occurrence and due to family dispute the petitioners have been made accused in the case.

On behalf of the State, it has been submitted that petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxzar in connection with Industrial Area, Buxar PS case No. 40/2015 subject to condition as laid down under section 438(2) of the Cr. P.C.
