2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act .

3. Prosecution case is that 150 liters illegal liquor were recovered from spot.

4. It is submitted that the petitioners are innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners.

5. Learned counsel for the State submits that

Patna High Court CR. MISC. No. 54724 of 2023(3) dt.31-08-2023 2/2 petitioner No. 1 has got 4 criminal antecedents of which 3 are of similar nature and petitioner No. 2 has got 3 criminal antecedents of which 2 are of similarly nature .
