Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act.

55 bags of Mahua flower each containing 40 Kg were recovered from a pick-up van when the driver of the vehicle was made accused. The petitioner was not named in the prosecution report but subsequently his name sprang up as the owner of the alleged pick-up van.

It is submitted by learned counsel for the petitioner that prosecution report does not suggest that the driver suggested the name of the petitioner when the pick-up van was intercepted and the seizure was made. But subsequently when the petitioner made application for release of the pick-up van then the prosecution sought to implicate the

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Excise Case No. 06 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
