The petitioners apprehend their arrest in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code. As per the prosecution case, co-accused Kiran Devi administered poison to the son of complainant Dharamvir Yadav (deceased) as a result of which he died.

It is submitted that specific accusation is against coaccused Kiran Devi. Petitioners have been made accused in this

Patna High Court CR. MISC. No.52653 of 2022(2) dt.20-12-2022 2/2 case only because they happens to be the relatives of co-accused Kiran Devi. There is no whisper about the petitioners in the complaint case. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Madhubani in connection with Rajnagar P.S. Case No. 25 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
