The same notification and provision was subject matter of challenge before us in C.W.J.C. No.24059 of 2013 and on 27.4.2017, a Co-ordinate Bench of this Court has dismissed identical writ petition challenging the same provision after relying upon an earlier judgment of the Hon'ble Supreme Court reported in 2004(4) PLJR SC 177 (State of Himachal Pradesh and others vs. M/s Shivalik Agro Poly Products and others).
