JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-08-2016 Heard learned counsels for the petitioners and the State. The petitioners being father in law and husband of the informant are languishing in custody since 10.6.2015 and 25.5.2016 in a case registered for the offences punishable under Sections 341,323,307,498A and 302/34 of the Indian Penal Code. The specific case of the informant was that the petitioners and the informant's mother in law poured kerosene oil on the informant when father in law lit the fire. All the accused persons came out of the house and closed the door from outside. On noise, the neighbours came, thereafter the husband of the informant took her to hospital where she succumbed to the injuries.
Patna High Court Cr.Misc. No.29835 of 2016 (3) dt.29-08-2016 2/2 It is submitted by the learned counsel for the petitioners that the mother of the informant has retracted from the initial version and filed a petition to that effect before the learned court below.
Considering the specific accusation by the informant against the petitioners, this court is not inclined to grant bail to them in connection with Belaganj P.S. Case No. 60 of 2015 pending in the court of learned CJM, Gaya.
This application is, accordingly, dismissed. However, let the trial be expedited.
