Petitioner is in custody in connection with Khodawandpur P.S. Case No. 31 of 2020 for the offence under sections 272, 273/414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that in the instant case total 116.76 liters of foreign liquor was seized from a ditch and not from the conscious possession of the petitioner or from the house of the petitioner.
The petitioner is in custody since 10.10.2020. Considering the fact that nothing was recovered from the possession of the petitioner, the Court is inclined to grant
Patna High Court CR. MISC. No.9587 of 2021(2) dt.08-02-2021 2/2 bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge,Excise, Begusarai, in connection with Khodawandpur P.S. Case No. 31 of 2020 subject to the condition that the petitioner shall deposit Rs. 50,000/-cash in the court below and the amount of Rs.50,000/- cash deposited by the petitioner shall abide by final outcome of the pending criminal case.
