2. The petitioner apprehends his arrest in connection with Madhepura P.S. Case No. 1204 of 2023, registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.
3. While the informant along with his wife went to a distant place and his sister-in-law along with his grand son were present in the house, in the meanwhile, some unknown thieves entered into the house of the informant and has stolen away various valuables articles.
4. Learned Advocate for the petitioner contended that the FIR has been instituted against unknown thieves. However, during the course of investigation one of the co-accused Chhotu

No.50700 of 2025(2) dt.11-08-2025 2/3 Kumar was apprehended and the name of the petitioner has sprung up on the confessional statement of said Chhotu Kumar; save and except the confessional statement, there is no other material. The recovery which is said to have been made from Madhepura Jewellery Main Bazar, the petitioner has neither any concern with the shop in question nor with the recovered articles. In fact, on account of two past criminal antecedent, name of the petitioner has been implicated in this case without there being any material. Taking note of the aforesaid fact, one of the co-accused person whose name also transpired on the confessional statement of co-accused has been accorded the privilege of anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 30560 of 2025 vide order dated 28.07.2025.
5. On the other hand, learned Advocate for the State vehemently opposes the bail application and submits that the petitioner bears two criminal antecedent and moreover his name has been disclosed by the apprehended person.
6. Having considered the submissions set forth by the learned Advocates for the respective parties and taking note of fact that there is no recovery of any stolen material from the whereabouts of the petitioner and save and except the

No.50700 of 2025(2) dt.11-08-2025 3/3 confessional statement, there is no other cogent material, coupled with the fact that the case of the petitioner is based on parity, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Madhepura in connection with Madhepura P.S. Case No. 1204 of 2023 , subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
