The petitioner apprehends his arrest in a case under Sections 269, 315/34 of the Indian Penal Code and Section 2(4) of the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulation Act, 2002.

The informant alleged that he admitted his wife for delivery to the clinic of Dr. Lalan Singh where the petitioner was working as a nurse. It is alleged that due to negligence of the petitioner and the doctor, the new born child died. It is submitted that the child was born in normal condition but the doctor found the condition of the child serious and, therefore, referred the child to Viratnagar Nobel Medical College and Hospital, Nepal for better treatment. Dr. Lalan Singh has already been granted anticipatory bail vide order passed in Cr. Misc. No. 28585 of

Patna High Court Cr.Misc. No.13714 of 2015 (2) dt.07-05-2015 2/2 2014.

Considering the facts aforesaid, the above named petitioner, in the event of her arrest or surrender in the court below within four weeks from today, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Birpur (Supaul) in Birpur P.S. Case No. 159 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
