ANJANA MISHRA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners No. 1, 2 and 4 have been in custody since 09.06.2018 whereas petitioner No. 3 has been in custody since 20.06.2018 in connection with Jamo Bazar P.S. Case No. 77 of 2018 registered for the offences punishable under Sections 147/ 148/149/341/323/324/307/302 of the Indian Penal Code. The allegation against the petitioner is that they were part of a crowd which assaulted several family members of the informant and as a result of such attack, the father of the informant was injured and he subsequently died.
Learned counsel for the petitioners submits that so far as Rudal Manjhi (petitioner No. 1) and Nawlesh Manjhi
Patna High Court Cr.Misc. No.59439 of 2018 (2) dt.28-09-2018 2/2 (petitioner No. 3) are concerned, though it is alleged in the First Information Report that they had attacked Dharmendra Manjhi and Chandrawati respectively. The injuries purported to have been inflicted on them by these two petitioners have been found to be simple in nature. It is further submitted that so far as Alha Manjhi and Urmila Devi are concerned no specific role has been attributed to them. It is next submitted that these petitioners are having no criminal antecedent and one similarly situated co-accused has since been extended the privilege of regular bail vide order dated 18.09.2018 passed in Cr. Misc. No. 51338 of 2018. In view of the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., VIII, Siwan, in connection with Jamo Bazar P.S. Case No. 77/2018.
