JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with allegation of loot. Petitioner carries criminal antecedent of near about six cases.
Submission on behalf of the petitioner is that prior to institution of the present case, petitioner lodged Complaint Case 2276 of 2014 against the informant of the present case and others and in retaliation of the aforesaid case, the informant lodged the present case. It is further submitted that so far as criminal antecedent of the petitioner is concerned, earlier six cases had been lodged against him, out of which, two cases had been lodged
Patna High Court Cr.Misc. No.30150 of 2016 (2) dt.05-08-2016 2/2 by the informant of the present case, whereas rest four cases had been lodged by the officer in-charge of Bhore Police Station on the same day.
Considering the aforesaid facts and circumstance of the case, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Bhore Police Station Case no. 153 of 2014, pending in the court of Judicial Magistrate, 1st class, Gopalganj stands rejected.
