BAJANTHRI) Date : 01-03-2024 The present MJC-Contempt petition is filed for noncompliance of the order dated 22.12.2020 passed in CWJC No. 6583 of 2020.

2. Limited direction was to submit representation within four weeks before the concerned authority whereas petitioner has submitted representation on 28.01.2021. Earlier without hearing the petitioner certain orders were passed, thereafter, this Court specifically directed the petitioner to appear before the concerned authority on 28.01.2024 at 3 P.M. After compliance of our direction the respondents have passed order on 28.01.2024. The order has been passed to the extent that certain reliefs sought by the petitioner has been complied.

3. On the other hand, learned counsel for the petitioner is still disputing to the extent that it is not in full compliance. Contempt of Court cannot examine in detail in respect of petitioner's representation for the reasons that limited direction was passed in CWJC No. 6583 of 2020 on 22.12.2020 to the

Patna High Court MJC No.1944 of 2021 dt.01-03-2024 3/3 extent of submission of representation and, thereafter, the concerned authority was required to consider. The petitioner had also not highlighted in the representation which are the Khesra Number, Khata Number and other materials so as to ask the concerned authority whether such illegal things have been removed or not? In the absence of such material information, the present contempt petition cannot be protracted. Accordingly, the proceeding of present MJC-Contempt petition stands dropped reserving liberty to the petitioner to approach the concerned authority in furnishing a detailed representation with reference to particular Khesra Number, Khata Number and other materials to the extent that certain illegal activities have been committed by certain persons. If such details are furnished before the concerned authority, the concerned authority is hereby directed to redress the grievance of the petitioner in the interest of justice and equity, at the earliest.
