Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. Petitioner and other accused were caught on the spot and from possession of the petitioner one country made loaded pistol and three cartridges were recovered whereas firearms were recovered from possession of other accused. Some motorcycles were also seized from the place of occurrence. It is stated that
Patna High Court Cr.Misc. No.29757 of 2016 (2) dt.28-07-2016 2/2 petitioner was found sitting on a motorcycle but submission on behalf of the petitioner is that the aforesaid motorcycle belongs to brother of the petitioner. It is further submitted that earlier petitioner was made accused in four cases, out of which in two cases he was acquitted, in one case final form was submitted whereas in another case he was granted bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Siwan in connection with Daraunda P.S. Case No. 45 of 2016.
