Heard counsel for the State.

The submission of the petitioner is that an objection has been filed in the pending certificate proceeding before the respondent-Certificate Officer, but the same has not been disposed of. Instead, coercive steps have been taken against him. In the counter affidavit filed on behalf of respondent nos. 3 to 5 it has been admitted that the petitioner has filed an objection before the Certificate Officer.

If that be the case, then the Certificate Officer is obliged to consider and pass appropriate order thereon, if not already disposed of.

Non appearance of the petitioner before this Court may be a situation before the Certificate Officer. However, considering

Patna High Court CWJC No.7847 of 2015 (7) dt.28-07-2015 2/2 the legal requirement and the fact that the objection has already been filed, the Certificate Officer would pass an appropriate order thereon in accordance with law as quickly as possible preferably within four weeks from the date of production/communication of this order.
