The petitioner seeks bail in Phulwaria P.S. Case No. 185/2018, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner has submitted that petitioner has clean antecedent. He is in custody since 07.08.2018. It is alleged in the written report that about 38 litres of foreign liquor has been recovered from Bathan of co-accused Suvindra Singh. Seizure-list is part of F.I.R. wherein it is mentioned that said liquor has been recovered from Bathan situated near the house of this petitioner and Suvindra Singh.
Considering the aforesaid fact and circumstances,
Patna High Court Cr.Misc. No.56683 of 2018 (2) dt.28-09-2018 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj in connection with Phulwaria P.S. Case No. 185/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
