JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being the husband of the deceased is languishing in jail custody since 01.09.2013 in a case registered under section 304B and other minor sections of the Indian Penal Code.

The learned trial court has reported that trial of the petitioner has already commenced and some prosecution witnesses have been examined. The informant has also been examined and partly cross examined but she is not coming for further crossexamination. The aforesaid report of trial court goes to show that there is no likelihood of conclusion of trial of the petitioner in near future, although trial court has sought five months time for conclusion of trial of the petitioner.

No.31194 of 2016 (3) dt.07-09-2016 2/2 Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Adhoc Additional Sessions Judge-III, Rohtas at Sasaram in connection with Session trial no. 29 of 2014, arising out of Darihat P.S.Case No. 39 of 2013.
