Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504 of the Indian Penal Code.

No.15300 of 2021(2) dt.14-12-2021 2/3 It is alleged that petitioner No. 2 assaulted the father of the informant on his head, as a result of which, he fell down and received head injury. The petitioner No. 1 is alleged to have assaulted on the hand of the father of the informant by lathi.

Considering the fact that petitioner No. 2 assaulted the father of the informant on his head, as a result of which, he received head injuries, this Court is not inclined to grant anticipatory bail to petitioner No. 2. The petition for grant of anticipatory bail to petitioner No. 2 is rejected.

So far as petitioner No. 1 is concerned, since petitioner No. 1 is alleged to have assaulted with lathi on the hand of the father of the informant which is not a vital part, this Court is inclined to grant privilege of anticipatory bail to petitioner No. 1.

Let the petitioner No. 1, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on

No.15300 of 2021(2) dt.14-12-2021 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 325 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
