Though the present writ petition has been filed for directing the respondents not to construct check dam on River Kharach, however, at the outset, the learned counsel for the respondent-State has submitted by referring to paragraph no.7 of the counter affidavit filed in the present case that on account of

Patna High Court CWJC No.4005 of 2021(4) dt.18-12-2024 2/2 the protest made by the villagers of Kapasi Village, the construction work of pucca check dam has been stopped, hence the present writ petition has been rendered infructuous.

2. Accordingly, the present writ petition stands disposed off, however, with liberty to the petitioner to take recourse to the due process of law, in case the construction work of the check dam is resumed.
