2. The petitioner is in custody in connection with Sessions Trial No. 423 of 2015 arising out of Madhuban P.S Case No. 119 of 2012 from the Court of learned ADJ-16, East Champaran, Motihari registered for the offences punishable under Sections 147, 148, 149, 302, 307, 448 of the I.P.C & 27 of the Arms Act.
3. As per allegation in the FIR, It is a case of firing pistol on the waist of the informant and on the
Patna High Court CR. MISC. No.60565 of 2023(6) dt.22-02-2024 2/3 chest of the son of the informant and later on firing on the waist of the sasur of the informant by other coaccused person.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that petitioner has no knowledge regarding the alleged incident. It is also submitted that petitioner is in judicial custody since 28.06.2014.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. In view of the allegation, on perusal of postmortem report and on the basis of written report, the witnesses has supported the occurrence of the crime and there is specific allegation against the petitioner that the petitioner has assaulted the informant and her son by gunshot. The injury report also corroborates with the alleged occurrence, this Court is not inclined to grant bail to the petitioner.
Hence, prayer for regular bail of the petitioner is hereby rejected and trial court is directed to conclude
