JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 25-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On account of recovery of dead body of unknown person, on the fardbeyan of chowkidar Khudabaksh, instant case has been registered. As is evident from case diary, dead body of a female was also recovered at some distance and for that, another case was instituted bearing Fatua P.S. case no. 199 of 2016. Subsequently thereof, it has also been traced out from the case diary that the lady was possessing a purse wherefrom a receipt was found and on the basis thereof, ultimately police had traced out the dead body of the lady to be that of wife of Manoranjan Kumar and accordingly, Manoranjan Singh, Suresh Singh; his father, Subodh Singh (petitioner) co-villager were apprehended and remanded in

Patna High Court Cr.Misc. No.45727 of 2016 (6) dt.25-01-2017 2/2 the aforesaid case. Although, there happens to be no connectivity in between both the deceased but from the conduct of Investigating Officer, it is evident that because of affectionate relationship in between both the deceased, in the background of inculpatory extra-judicial confessional statement of co-accused have been accepted and further, on the basis thereof, apart from those three persons, some other culprits have also been identified as is evident from para 60 of the case diary. So, virtually no evidence persist against the petitioner relating to present case and on account thereof, petitioner Subodh Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Masaurhi, Patna in connection with Punpun P.S. case no. 137 of 2016.
