Petitioner seeks bail in Malsalami P.S. Case No.20 of 2008 (S. Tr. No.1080 of 2011) instituted for the offence under Section(s) 395, 412 Indian Penal Code and Section 3⁄4 of the Explosives Substance Act.

It is a case of misuse of privilege of bail. Bail bond of the petitioner was cancelled on 13.11.2014. He is in custody since 23.12.2016.

This Court finds that petitioner has sufficiently been punished for the latches committed by him.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.56274 of 2018 (2) dt.04-10-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, VII, Patna City, Patna, in connection with Malsalami P.S. Case No.20 of 2008 (S. Tr. No.1080 of 2011), subject to the condition that both the bailors shall be close relative of the petitioner. The petitioner will remain present on each and every date of trial and his absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled.
