The petitioner is accused in connection with Jandaha P.S. Case No. 20 of 2016 registered under sections 302, 201/34 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that this is a case of accidental death while cooking. The matter has been compromised.

Learned A.P.P. appearing on behalf of the State opposes the prayer of the petitioner and submits that during investigation witnesses have supported the prosecution case. I.O. had found smell of kerosene oil coming from the room when victim died. The case is under section 302 I.P.C. and as such,

Patna High Court Cr.Misc. No.47343 of 2016 (4) dt.17-02-2017 2/2 there is no question of compromise.

Having considered the facts and circumstances of the case and the nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, petitioner may renew his prayer for bail after framing of charge.
