The petitioner has filed the instant application for grant of regular bail in connection with Jakkanpur P.S. Case no. 259 of 2020 registered under sections 401 and 414 of the Indian Penal Code.
As per allegation in the FIR, on a secret information having been received a raid was conducted. It is stated that at the alleged place the petitioner was taken into custody and from his possession a stolen Piaggio vehicle besides other articles including rinch, knife, number plate, helmet, etc., were recovered. On inquiry the petitioner disclosed that he along with others used to give effect to occurrences of theft etc. in various

It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case only for the reason of his antecedents. He was arrested purely on suspicion. The FIR does not mention about any occurrence having taken place nor the petitioner has been put on T.I. parade. He is in custody since 30.5.2020, i.e. for one year. The application for bail is opposed by learned Additional Public Prosecutor for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR together with the petitioner having remained in custody for one year, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Jakkanpur P.S. Case no. 259 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- I, Patna.
