2. This memo of appeal is directed against the order dated 13.06.2022 passed in C.R. No. 178/2019 passed by the court of learned Special Judge SC/ST (POA) Act, Samastipur whereby and whereunder the learned court took cognizance in the matter for offences under 323 of the Indian Penal Code and Section 3(i)(r)(s) of the Schedule Caste and Schedule Tribes (Prevention of Atrocities) Act against the appellant.

3. Learned counsel for the appellant submits that he has good case, contradictions are there, still cognizance has been taken. However, for the present, he intends to withdraw the petition and approach the Court at an appropriate time.

4. Granting said liberty, the appeal stands disposed of as withdrawn.

5. The interim relief granted on 18.07.2023 stands vacated.
